The new Corporate Manslaughter Bill makes it far easier for organisations whose senior managers have breached their duty of care, to be prosecuted. Historically many prosecutions failed against all but the smallest organisations, so the new act could, potentially, see a dramatic rise in the number of successful corporate manslaughter cases, the first of which was brought in April 2009.
The new act holds all employers accountable for the actions and decisions of their senior managers, so it is essential that senior managers and their teams understand and comply with the latest legislation. This includes not just the corporate manslaughter act but also an important raft of legislation now in place; to ensure the workplace is safe this knowledge should be updated regularly.
This intensive and informative one day workshop provides guidance on good practice and how providers and employers can best meet the latest requirements.
For Whom
The workshop is designed for all managers and HR teams as well as teachers, trainers and learning support teams who have to both comply with and cascade health and safety legislation to learners.
Aims and objectives
To help delegates recognise the health and safety legislation changes that have been, or are about to be made, and the effect upon them, their organisation, partners, customers and learners
As a result of attending this workshop, delegates will:
- Recognise health and safety legislation that has recently changed
- Be aware of new legislation that has been introduced
- Understand why the changes were made or new legislation introduced
- Associate the changes with practices within their own areas of operation
- Be able to ensure compliance with the new requirements
Content
This workshop provides information and advice on the latest key health and safety legislation that impact on all organisations. Delegates will be reminded of the current/previous requirements before being introduced to the latest and significant changes that have been made, or are pending. In doing so participants will explore the impact and effect of the changes will have for learning providers, employers and learners.
Recent New legislation, including:-
- The Regulatory Reform (Fire Safety) Order 2005 – introduced in October 2006
- The Corporate Manslaughter and Corporate Homicide Act 2007 (MoJ)
- Health and Safety (Offences) Act 2008 - effective from January 2009
Legislation that has changed recently including:-
- The Control Of Asbestos Regulations 2006 – introduced in November 2006
- The Construction (Design and Management) Regulations 2007
- The Work At Height Regulations 2005 – introduced in April 2006 -amended
- The Control Of Noise At Work Regulations 2005 - amended
Other changes that were made in 2009 including:-
- The Health and Safety (First Aid) Regulations 1991 – amended October 2009
- The Health and Safety Information for Employees (Amendment) Regulations 2009
- The Supply of Machinery (Safety) Regulations 2005 – amendment in force from Dec 29 2009
Learning Style
This workshop is delivered primarily via tutor presentation and discussion. It should be noted that due to the legislative nature of the workshop there is little opportunity for practical exercises although participative questioning is encouraged throughout.

Formal Certificates of Development will be issued, by post, to participants who complete this workshop. These certificates will detail the key learning aims and the face-to-face learning hours undertaken, enabling participants to update their CPD records and logs accordingly. The workshop also allows time, during the day, for participants to reflect on and record their personal learning development and consider how best to apply the knowledge gained on return to work. This element of the programme is designed to maximise the benefits from attending and enable participants to make better review judgments when recording their CPD activities.
