The Equality Act 2010 - Understanding the Implications for Schools and Colleges  (WS3359)

All organisations that receive Government funding are expected to operate to the highest standards in promoting equality and diversity. Government Ministers have already pointed out that with an annual expenditure of around £200 billion every year on goods and services, the public sector has “an important opportunity to use its purchasing power to promote equality”. Existing legal public duties on these procurement or purchasing issues - covering race, gender and disability - are being extended in to cover age, sexual orientation, gender reassignment, religion & belief, now that the Equality Act (2010) has received Royal Assent.

The new Equality Act 2010 is likely to impose new obligations on schools and colleges as well as providing exemptions from some of its general clauses.  In addition the way in which some of the general equality clauses providing protection may manifest themselves could be different with in education. 

This workshop explores the Equality Act and how it is likely to apply to schools and colleges.  It looks specifically at what the new obligations and exemptions are likely to be and how they might impact on these sectors. 

Content of this workshop is based on the most recent published requirements but, as it is likely that the new Government will want to review the legislation before it is finalised, some further changes cannot be ruled out. Consultations on a range of issues are planned, including the publication of draft Codes of Practice covering the new public sector duties, and enabling clauses, which will be laid before both the lower and upper houses over the lifetime of this parliamentary session. 

The workshop aims to ensure delegates are in the best possible position to act on the final legislation by giving them the latest information on the possible requirements and implications.

This one day workshop is designed to help participants to understand the latest legal requirements of the Equality Act 2010 as applicable to schools and colleges including:

  • Secondary Schools
  • Further Education Colleges
  • Universities

The event may also have some relevance to private training providers and infrastructure organisations who are interested in knowing what might be expected from public sector providers.

Aims and Objectives

  • To provide an overview and update on and latest “state of play” on the Equality Act 2010 and the anticipated intentions of Coalition Government
  • To examine the specific exemption clauses of the Equality Act in so far as they relate to schools and colleges
  • To consider how the protected characteristics within the Equality Act generally will precisely impact on schools and colleges
  • To provide advice and guidance for schools and colleges in drafting and implementing formal policies on equality and diversity, single equality schemes and impact assessments

This intensive one day workshop places a sharp focus on the new obligations, exemptions and specific applications that are likely to apply to Schools and Colleges.

1 Review of the prevailing legal situation/expectations

  • Snapshot of the existing equality law framework

  • Content and parliamentary passage of the Equality Bill, April 2009.

  • Expectations - Ofsted Inspection and similar scrutiny regimes

Please note that the first 90 minutes of the workshop provides a summary overview of the key underpinning legislation and delegates. Delegates who have attended, recently any of our workshop on Understanding and Implementing the Latest Legislation, our 2/3 day Equality and Diversity related programmes may wish to miss this session and arrive at 10.45 for core content.

3 The New Exemptions

4 Variations in the Act for Schools and Colleges
Some of the protected characteristics, equality clauses and concepts of discrimination could manifest themselves differently in schools and colleges. For example:-

The workshop is led by an equality and diversity professional with experience as a former officer with the Equality and Human Rights Commission, and its predecessor body the Equal Opportunities Commission

These certificates will detail the key learning aims and the face-to-face learning hours undertaken, enabling participants to update their CPD records and logs accordingly.
